ABSTRACT MUHAMMAD SARDI D101 20 266. Responsibility Of The Parties In Electronic Contracts For Kredivo Application Users. Supervised by Nurul Miqat, and Aifan. The development of financial technology (fintech) in Indonesia has brought significant changes to financial services, one of which is through the Kredivo application that provides digital credit facilities for the public quickly and conveniently. Although offering ease of access, this service also gives rise to various legal issues such as inaccurate payment records, the imposition of late fees despite timely payments by users, and transactions executed without the account owner's consent. These problems raise questions regarding the responsibility of the service provider towards users who suffer losses. This study formulates two main issues, namely the extent of Kredivo‘s responsibility for users who experience losses due to system errors, and the dispute resolution mechanisms applied within the application. The research method used is normative juridical, by examining prevailing laws and regulations as well as relevant legal literature to obtain answers to the issues discussed. The results indicate that Kredivo‘s responsibilities include the obligation to provide legal protection, ensure transparency of information, and offer fair and accessible dispute resolution mechanisms. However, the form of agreement used is a unilateral agreement (standard contract) in which all clauses are determined by Kredivo without giving users space for negotiation. This situation places users in a weaker position, especially with the existence of liability limitation clauses that hinder users' rights to claim compensation for significant losses. Based on the Electronic Information and Transactions Law (UU ITE), the Consumer Protection Law, and OJK Regulation No. 10/POJK.05/2022, electronic system providers remain obligated to provide compensation for losses arising from system errors. Keywords: Fintech, Electronic Contract, Kredivo, User Protection, Legal Liability.
