| Abstrak ABSTRACT Dede Nataniel RB, D10119429, Legal Review of Insurance Agreements in the Delivery of Goods through PT J&T Express (Case Study: PT J&T Express Palu Branch). Supervisors : Abraham Kekka and Rosnani Lakuna. This research examines in depth the legal aspects related to the delivery of goods through the expedition service of PT J&T Express, particularly those concerning insurance agreements. The objectives of this study are to determine the implementation of insurance agreements for goods delivery at PT J&T Express in Palu City and to analyze the responsibility of PT J&T Express in the event of damage or loss of goods based on the delivery insurance agreement. The results of this study show that the principles and doctrines applicable in insurance agreements are fundamental, referring to the consensual principle which emphasizes the importance of mutual agreement between the parties involved. Freedom of contract provides flexibility for the parties to formulate agreements according to their respective needs and interests. In this context, the binding principle indicates that agreements that have been mutually agreed upon are legally enforceable. Furthermore, the principle of trust serves as an essential foundation, as the relationship between the insurer and the insured is built upon confidence that each party will fulfill its obligations. In fulfilling its responsibilities, J&T Express demonstrates its commitment to providing full compensation to consumers whose goods are damaged or lost, especially for those who have insured their shipments. The company has provisions to pay compensation amounting to ten times the shipping cost, with a maximum limit of Rp2,000,000.00 (two million rupiah). Compensation will be paid according to the value of the goods stated in the insurance policy, or by providing replacement goods of the same type in the event of breach of contract in the delivery agreement. If J&T Express fails to meet its obligations, the company is required to reimburse all costs, losses, and interest incurred, as regulated under Article 1243 of the Indonesian Civil Code. The recommendation from this study is that PT J&T Express should improve supervision of all employees to prevent mistakes caused by negligence or violations of written and unwritten regulations. Consumers are also expected to remain cautious and wise when conducting goods delivery activities. Keywords: Agreement, Insurance, J&T Express |
